Terms and Conditions on Data Protection
“Naspire” refers to the service provided subject to these General Terms and Conditions.
The protection of your personal data is of utmost concern to Naspire.
In these terms and conditions on data protection Naspire would like to inform you about how Naspire treats your personal data and how you can exchange this data with other users of Naspire.
Naspire.com is an online networking service for professionals and entrepreneurs designed to provide an easy way for our members to network with each other to establish mutually beneficial business relationships.
There are two types of user-submitted information we collect: Public and Private.
- PUBLIC INFORMATION:
We define Public information as personal information that may be displayed on the site, included but not limited to the information users post in their profiles. Public information is meant to be seen by members and visitors to the site but cannot be used to identify a specific member by name, address, etc.
- PRIVATE INFORMATION
- Private information is defined as any information that allows others to contact a user other than through the Naspire.com web site. When members email each other through the Naspire.com web site member’s private email addresses are not disclosed. Private information includes, but is not limited to email address, first name, last name, credit card number or checking account information for payment, a user-specified password, mailing address, zip code and telephone number. Naspire does not sell, rent, share, trade, lease or give away its customer lists containing private information to third parties unless you specifically authorize us to do so, except to the billing service used by Naspire and the Naspire.com web site, the financial institution that processes your credit card or check the transaction and unless required by law or for the protection of your membership or as otherwise set forth in this Privacy Policy.
- AGGREGATE INFORMATION:
Aggregate information is not directly submitted by users to Naspire.com. This is the information we collect that is not personally identifiable, such as browser type and IP address. This information is gathered for all users to the site. We use your server, IP address, and browser-type related information in the general administration of our website. - Naspire may provide to third parties aggregated information about the user that is disclosed by the user in connection with the use of the site and information about the user’s use of the site. Except as otherwise stated in this privacy policy or with the approval by or on behalf of the user or as required by law, Naspire will not disclose the user’s name, email or mailing address, or telephone or facsimile number. Naspire will not review, change, edit or disclose communications to or from the user in connection with the use of the site, except: (A) in the event of a breach of user’s agreement with Naspire, Inc.; (B) as required by law; (C) in connection with claims that the rights of third parties have been violated; (D) to protect the rights of Naspire, (E) or as otherwise set forth herein.
- Please keep in mind that if you directly disclose personally identifiable information or personally sensitive data by posting this information in your profile on the Naspire.com web site or by emailing it to other Naspire.com members, this information may be collected and used by others. Note: Naspire does not read any of your private online communications. Your e-mails to other members are completely confidential.
- Naspire may send you a welcome letter or email explaining the features provided by the service. Naspire may also send periodic member letters to announce important service changes, new features, technical issue updates and news about other Naspire products and services. Naspire may also contact you via surveys or contests to conduct research about your opinion of current services or of potential new services that may be offered. Participation in these surveys or contests is completely voluntary and the user, therefore, has a choice whether or not to disclose this information. Survey information collected will be used for purposes of monitoring or improving the use and satisfaction of the site.
- Naspire may, from time to time, also contact you on behalf of external business partners about a particular offering that may be of interest to you. In those cases, your unique personally identifiable information (e-mail, name, address, telephone number) is not transferred to the third party. In addition, Naspire may share data with trusted partners to help us perform statistical analysis. All such third parties are prohibited from using your personal information except to provide these services to Naspire and they are required to maintain the confidentiality of your information.
- Naspire will disclose your personal information, without notice, only if required to do so by law or in the good faith belief that such action is necessary to: (a) conform to the edicts of the law or comply with legal process served on Naspire or the site; (b) protect and defend the rights or property of Naspire, Inc.; and, (c) act under exigent circumstances to protect the personal safety of users of Naspire its web sites, or the public, (d) or as otherwise set forth in this Privacy Statement.
- The Naspire.com web site outsources its billing to a third-party billing service. This billing service uses SSL encryption technology (the Internet standard for secure transactions) to protect your credit card and account information. This billing service is prohibited from using your personal information except to provide these services to Naspire or as otherwise set forth in its Privacy Statement and is required to maintain the confidentiality of your information in accordance with its Privacy Statement. Naspire and all its personnel including but not limited to its shareholders, officers, directors, employees, agents, consultants and third parties are not responsible for the actions of this billing service, including any violation of its Privacy Agreement with Naspire or members of the Naspire.com web site.
- Use of Cookies:
Naspire.com uses “cookies” to help you personalize your online experience. A cookie is a piece of data stored on the user’s hard drive containing information about the user. Usage of a cookie is in no way linked to any personally identifiable information while on our site. Once the user closes their browser, the cookie simply terminates. We do not and will not use cookies to collect private information from any user. Cookies cannot be used to run programs or deliver viruses to your computer. One of the primary purposes of cookies is to tell the Web server that you have returned to a specific page. Cookies are used on the Naspire.com web site to control access to the member’s area. You have the ability to accept or decline cookies. Most Web browsers automatically accept cookies, but you can usually modify your browser setting to decline cookies if you prefer. If you choose to decline cookies, you will not be able to fully experience the interactive features of the Naspire.com web site.
Basic Principles of Naspire for handling your Personal Data
- Naspire strictly adheres to the following basic principles in the protection of your Personal Data:
- Naspire shall collect, process and use your Personal Data in accordance with the laws and statutes on data protection of the Federal Republic of Nigeria and those of the African Union.
- Naspire shall use your Personal Data solely to provide you the Naspire Services on the Internet for which you have registered. Naspire will never pass your Personal Data on to any third party, neither for advertising, nor for marketing or for any other purposes without your consent.
- With the exception of some general information about your profession, you alone decide which of the Personal Data you have made available to Naspire in your profile may be displayed by Naspire to other members of Naspire (cf. Section 3 of these Terms and Conditions on Data Protection).
- Persons not registered with Naspire may only view your Personal Data to the extent that you enable and allow them to do so (cf. Section 4).
Definitions
- The following terms used in these Terms and Conditions on Data Protection shall have the following meanings:
- “Personal Data”shall mean all data and/or information about your profession or your person.
- “Naspire Websites”shall mean all websites on which Naspire provides the Naspire Services.
- “Social Network”shall mean the contact and communication forums that belong to the applications of the Naspire service.
- “Profile”shall mean the Naspire Website where the Personal Data you have made available to Naspire is displayed in accordance with your specifications and your consent.
- “Naspire Members”shall mean all registered users with a visible profile in the Social Network.
- “Naspire Services”shall mean all services provided by Naspire on the Naspire Websites.
- “Registration Data”shall mean the Personal Data you are obliged to make available to Naspire in the registration process for the Naspire Services (mandatory fields).
- What does this mean? Think we should remove ‘registration based’ and leave as ‘all services’
What does Naspire know about you, what do you give Naspire and Naspire Members permission to do, and what happens with your Personal Data?
Registration Data
- In order for the Naspire Services to function, Naspire needs to collect and process certain elements of your Personal Data in the course of the registration process. First of all, this consists of the following data:
- Username
- Password
- Your password and/or your username are never visible to any Naspire Member at any time. Naspire shall never disclose or pass your password and/or your username on to any third party.
- Furthermore, you will need to fill out certain mandatory fields in the course of creating a Profile, such as:
- Business e-mail account
- Business telephone number
- First name, last name, form of address
- Date of birth
- Professional status
- Company name
- Position (Title)
- Industry
- Country, state and city of your company
- The following Personal Data from the Profile is accessible to other Naspire Members without any restrictions:
- First name, last name
- Professional status
- Company name
- Position (Title)
- Industry
- Country, state and city of your company
- With respect to the following Personal Data in the Profile, you may choose in each individual case whether the data shall be displayed to a specific other Naspire Member or not:
- Business e-mail account
- Business telephone number
- Date of birth
Voluntary Data in the Profile
- If you wish, you may add more information about yourself to your Profile on a voluntary basis (hereinafter referred to as “Voluntary Data”), to allow other Naspire Members to get to know you better and possibly encourage them to choose you as an appropriate business contact. At the moment, you are able to choose from the following Voluntary Data, for example: your interests, your education, what you have to offer to other Naspire Members, what you are looking for from other Naspire Members, etc. You may also upload a photograph and/or video of yourself, if you wish.
- The Voluntary Data you choose to enter in your profile is accessible to all other Naspire Members. With some of the Voluntary Data you may choose in each individual case if the data shall be displayed to a specific other Naspire Member.
- You can revoke Voluntary Data at any time by deleting the data in question from your profile.
Your Profile, Contact Management
- The following sections of the Personal Data you have made available to Naspire is visible to all other Naspire Members:
- First name, last name
- Professional status
- Company name
- Position (Title)
- Industry
- Country, state and city of your company
- All other Naspire Members may access your Profile and view the information displayed on the Profile, including such Voluntary Data you have specified to be made available to all other Naspire Members. Certain Naspire Members may be able to access further of your Voluntary Data in accordance with your specifications (chosen settings) for the respective Naspire Member in each individual case.
- Naspire has set your privacy settings under “Privacy” by default so that your list of confirmed contacts is displayed to all Naspire Members. However, you may change this setting at any time by yourself to the effect that your list of confirmed contacts is not visible to anybody at all or only to certain of your contacts, for example to the direct contacts of your contacts (i.e. second-level contacts) or only to third-level or fourth-level contacts.
- The following of your personal statisticsare visible to all Naspire Members at all times:
- Number of your confirmed contacts
- Number of hits on your Profile
- Month and year of your membership
- Type of membership
- On your profile you will find an activity meter. This meter indicates whether you use the Naspire services regularly, however, it does not show any details about the way or the times you use the Naspire services. The activity meter is intended as an indication for other Naspire members to determine how intensely you use the Naspire services so that the other Naspire members can evaluate whether you will presumably react fast on a request via the Naspire services. You may suppress the activity meter at any time in the settings to your privacy under “Privacy” to the effect that the activity meter is not visible to other Naspire members.
- Other Naspire Members may send you private messages in order to establish contact with you. Naspire has set your privacy settings under “Privacy” by default so that all Naspire Members may send you private messages. You may restrict the ability of Naspire Members to send you private messages at any time to the effect that either no Naspire Members or only selected contacts may send you private messages, for example only the direct contacts of your contacts (i.e. second-level contacts) or only third-level or fourth-level contacts.
- As you see, Naspire gives you complete control over your own privacy at all times.
Your comments
- You can like, find interesting and comment on your contacts’ activity (hereinafter referred to as “comments”). Your comments are then visible to the network of the contact on whose activity you commented. You can delete your comments at any time.
Changes to this Statement
- Naspire will occasionally update this Statement of Privacy to reflect company and customer feedback. If there are material changes to this Statement or in how Naspire will use your personally identifiable information, Naspire will prominently post such changes prior to implementing the change. Naspire encourages you to periodically review this Statement to be informed of how Naspire is protecting your information.
